Information We Collect
Information You Provide
When you create an account on Mutual4ex, purchase an evaluation program, or contact our support team, we collect personal information that you voluntarily provide. This includes your full name, email address, phone number, date of birth, residential address, government-issued identification documents (for KYC verification), and payment information such as billing address and the last four digits of your card. If you participate in our affiliate or referral programs, we also collect your payout preferences and tax identification information where required by law.
Automatically Collected Data
When you access or use the Mutual4ex platform, we automatically collect certain technical and usage data. This includes your IP address, browser type and version, operating system, device identifiers, referring URLs, pages visited, time spent on each page, click patterns, and the date and time of each visit. We collect this data through server logs, cookies, and similar tracking technologies to maintain platform security, diagnose technical issues, and improve the user experience.
Trading Activity Data
As part of our evaluation and funded trading programs, we collect and store comprehensive trading activity data. This includes trade history (entry and exit prices, position sizes, instruments traded), account balance and equity snapshots, drawdown metrics, profit targets progress, risk management statistics, and trading session timestamps. This data is essential for evaluating your trading performance, enforcing program rules, and determining payout eligibility.
How We Use Your Information
Service Delivery
We use your personal and trading data to operate, maintain, and deliver the core Mutual4ex services. This includes processing your evaluation program purchases, provisioning and managing your trading accounts, monitoring your performance against program rules, calculating and processing profit-share payouts, verifying your identity through our KYC procedures, and providing customer support. Your payment information is used exclusively to process transactions through our payment providers.
Platform Improvement
We analyze aggregated and anonymized usage data to understand how traders interact with our platform, identify areas for improvement, develop new features and evaluation programs, optimize our website performance, and personalize your experience. We may use trading performance data in aggregate (never individually identifiable) for statistical analysis, research, and to improve the fairness and structure of our evaluation programs.
Legal & Compliance
We process your information as necessary to comply with applicable laws, regulations, and legal obligations. This includes anti-money laundering (AML) and know-your-customer (KYC) compliance, fraud prevention and detection, responding to lawful requests from law enforcement or regulatory authorities, enforcing our Terms of Service and program rules, and protecting the rights, property, and safety of Mutual4ex, our users, and the public.
Marketing Communications
With your consent, we may use your email address to send you promotional communications about new evaluation programs, platform updates, special offers, and educational trading content. You can opt out of marketing emails at any time by clicking the unsubscribe link in any marketing email or by contacting us at support@mutual4ex.com. Opting out of marketing communications will not affect transactional emails related to your account, such as purchase confirmations, payout notifications, and security alerts.
Information Sharing & Disclosure
We Do Not Sell Your Data
Mutual4ex does not sell, rent, or trade your personal information to third parties for their marketing purposes. We will never monetize your data by making it available to advertisers, data brokers, or any other third party. Your trust is the foundation of our business and we treat your data with the highest level of respect and responsibility.
Service Providers
We share limited personal information with trusted third-party service providers who assist us in operating our platform and delivering services to you. These providers include: Stripe for processing credit and debit card payments; NowPayments for processing cryptocurrency transactions; Supabase for secure database hosting, user authentication, and file storage; and Resend for delivering transactional and marketing emails. Each of these providers is contractually obligated to use your data only for the purposes we specify and to maintain appropriate security measures. We do not share more data with these providers than is strictly necessary for them to perform their services.
Legal Requirements
We may disclose your personal information if required to do so by law or in the good-faith belief that such disclosure is necessary to comply with a legal obligation, court order, or governmental request; protect and defend the rights or property of Mutual4ex; prevent or investigate possible wrongdoing in connection with our services; protect the personal safety of our users or the public; or protect against legal liability. We will make reasonable efforts to notify you of any such disclosure unless prohibited by law.
Business Transfers
In the event that Mutual4ex is involved in a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of its assets, your personal information may be transferred as part of that transaction. In such a scenario, we will notify you via email and/or a prominent notice on our website of any change in ownership or uses of your personal information, as well as any choices you may have regarding your information. The acquiring entity will be bound by the terms of this Privacy Policy with respect to your previously collected data.
Data Security & Storage
Security Measures
Mutual4ex implements industry-standard security measures to protect your personal information from unauthorized access, alteration, disclosure, or destruction. All data transmitted between your browser and our servers is encrypted using SSL/TLS (Secure Sockets Layer / Transport Layer Security) protocols. Sensitive data such as passwords is hashed using bcrypt algorithms and is never stored in plain text. We support and encourage the use of two-factor authentication (2FA) for account access. Our infrastructure is hosted on enterprise-grade cloud platforms with encryption at rest, regular security audits, automated vulnerability scanning, and strict access controls limiting employee access to personal data on a need-to-know basis.
Data Retention
We retain your personal information for as long as your account is active or as needed to provide you with our services. If you close your account, we will retain your data for a reasonable period as necessary to comply with our legal obligations (such as tax and financial record-keeping requirements), resolve disputes, enforce our agreements, and maintain audit trails. Trading activity data associated with completed evaluations is retained for a minimum of five years for compliance and dispute-resolution purposes. After the retention period expires, your data will be securely deleted or anonymized so that it can no longer be associated with you.
Data Breach Notification
In the unlikely event of a data breach that compromises your personal information, Mutual4ex will notify affected users without undue delay and no later than 72 hours after becoming aware of the breach, as required by applicable data protection laws. Notification will be provided via email and, where appropriate, through a prominent notice on our website. The notification will describe the nature of the breach, the types of data affected, the steps we are taking to address the breach, and recommendations for actions you can take to protect yourself.
International Data Transfers
Cross-Border Processing
Mutual4ex is a United States-based company and our primary servers and data processing facilities are located in the United States. If you access our platform from outside the United States, please be aware that your personal information will be transferred to, stored, and processed in the United States where our servers are located. By using the Mutual4ex platform, you consent to the transfer of your information to the United States and other jurisdictions where our service providers operate, even if those jurisdictions have data protection laws that differ from those of your country of residence.
Data Protection Standards
Regardless of where your data is processed, Mutual4ex applies the same high standard of data protection to all personal information. Where we transfer personal data from the European Economic Area (EEA), the United Kingdom, or Switzerland to countries that have not been deemed to provide an adequate level of data protection, we rely on appropriate safeguards such as Standard Contractual Clauses (SCCs) approved by the European Commission, or other legally recognized transfer mechanisms. We continuously monitor the legal landscape regarding international data transfers and will update our practices as necessary to remain compliant with applicable regulations.
Your Privacy Rights
Access & Correction
You have the right to request access to the personal information we hold about you at any time. Upon request, we will provide you with a copy of your data in a structured, commonly used, and machine-readable format. If any of your personal information is inaccurate or incomplete, you have the right to request that we correct or update it. You can update most account information directly through your Mutual4ex dashboard, or contact our support team for assistance with changes that require verification.
Data Deletion
You may request the deletion of your personal information at any time by contacting us at support@mutual4ex.com. Upon receiving a verified deletion request, we will delete your personal data from our active systems within 30 days, except where retention is required by law or necessary to complete a pending transaction, resolve disputes, or enforce our agreements. Please note that requesting deletion of your account data will result in permanent closure of your Mutual4ex account and forfeiture of any active evaluation programs.
Restriction & Objection
You have the right to request that we restrict the processing of your personal data in certain circumstances, such as when you contest the accuracy of your data or object to our processing. You may also object to the processing of your personal data for direct marketing purposes at any time. Where processing is based on your consent, you have the right to withdraw that consent at any time without affecting the lawfulness of processing carried out prior to the withdrawal.
GDPR Rights (EEA & UK Residents)
If you are located in the European Economic Area or the United Kingdom, you are entitled to additional rights under the General Data Protection Regulation (GDPR), including the right to data portability, the right to lodge a complaint with your local data protection authority, and the right not to be subject to automated decision-making or profiling that produces legal effects. To exercise any GDPR right, contact us at support@mutual4ex.com. We will respond to your request within 30 days and will not charge a fee for processing reasonable requests.
CCPA Rights (California Residents)
If you are a California resident, the California Consumer Privacy Act (CCPA) grants you additional rights regarding your personal information. You have the right to know what personal information we collect, use, disclose, and sell; the right to request deletion of your personal information; the right to opt out of the sale of your personal information (although Mutual4ex does not sell personal data); and the right to non-discrimination for exercising your privacy rights. To submit a CCPA request, email us at support@mutual4ex.com. We will verify your identity before processing any request and will respond within 45 days as required by law.
